About these terms

These Terms & conditions are an agreement between you and Light My Reptile LLC, an Oregon limited liability company that operates this Website. In these terms, Light My Reptile LLC, we and us refer to that company.

These terms apply to your use of the Website on and after 28 July 2026. Use before that date remains governed by the terms in effect at the time. By using the Website after the effective date, you agree to these terms. If you do not agree, do not use the Website.

You must be at least 18 years old to use this Website. By using the Website and agreeing to these terms, you represent and warrant that you are at least 18 years old.

Definitions

• Content means text, graphics, images, audio, video, software, data, page layouts, underlying code and other material stored on or forming part of the Website, including material submitted by users.
• Service means the lighting-planning tool and any related online facilities, accounts, submission features, consultations, paid services, information or other features made available through the Website.
• Third-party Material means Content owned or controlled by someone other than Light My Reptile LLC, including lamp measurements, charts, source material, product names, trademarks and brand assets.
• User or you means a person who accesses or uses the Website and is not acting for Light My Reptile LLC in the course of their work.
• Website means the Light My Reptile website on which these terms appear, including its pages and subdomains unless expressly excluded by separate terms.

Ownership and intellectual property

Except for user submissions and identified Third-party Material, the Website and its Content are owned by or licensed to Light My Reptile LLC. This includes the custom software, interface, original written content, page layout, code and graphics used to provide the Website. Third-party software components remain subject to their respective licences.

Some project material was created, acquired or contributed before Light My Reptile LLC became the Website operator. The company uses that material only to the extent that it owns it, is licensed to use it or otherwise has permission or legal authority to do so. The change of operator does not change the ownership of Third-party Material or enlarge a permission previously given by its owner.

Nothing on the Website grants, by implication or otherwise, a licence or right to use a trademark, logo, service mark, dataset or other protected Content without the relevant owner's permission. If source code or Content is accompanied by a separate express licence, that licence controls your use of that material.

Personal use and generated plans

For your own personal, non-commercial use, you may:

• retrieve, display and use the Website on a computer or mobile device;
• save setups using the features provided by the Website;
• download, store and print plan sheets or other exports generated for you; and
• share generated plan sheets and setup links for personal, community or educational purposes, provided you do not misrepresent their source or remove notices included in them.

You must not otherwise reproduce, modify, extract, copy, distribute, sell, license or use the Website, its software, its compiled lamp dataset or other protected Content for commercial purposes without written permission from Light My Reptile LLC and, where applicable, the owner of Third-party Material.

Third-party lamp data and trademarks

Lamp measurements, original test charts and related source material remain the property of their respective tester, owner or other rights holder. Where the Website reproduces or adapts that material, Light My Reptile LLC does so under the applicable permission, licence or other legal authority. Where available, the Website identifies the tester or owner, test year, voltage and a link to the relevant work or tester's website.

Our right to use Third-party Material does not transfer its ownership to us and does not give users permission to extract, republish or commercially use it. Lamp, manufacturer and product names, logos and trademarks belong to their respective owners. Their appearance on the Website is for identification and does not imply manufacturer sponsorship or endorsement.

User submissions

If you submit or otherwise provide Content, you are responsible for its legality, reliability, accuracy and originality. You must not provide Content that:

• is confidential, proprietary, false, fraudulent, defamatory, obscene, threatening, abusive or invasive of privacy or publicity rights;
• infringes intellectual-property or other rights;
• is unlawful, encourages an offence or could otherwise give rise to liability;
• contains malware, spam or unauthorised advertising; or
• misrepresents your identity or the origin of the Content.

You represent that you own or control the rights needed to provide the Content, that it is accurate to the best of your knowledge, and that the uses you authorise will not violate another person's rights. To the extent permitted by law, you are responsible for reasonable losses and third-party claims caused by your breach of those representations.

You retain ownership of your submissions. Unless a separate submission agreement says otherwise, submitting Content on or after 28 July 2026 grants Light My Reptile LLC a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, format and display it only as reasonably necessary to operate, improve or provide the relevant Service. Lamp measurements, charts and related source material will be added to the public catalogue only with the relevant owner's permission and the agreed attribution.

A submission or permission given before 28 July 2026 remains governed by the permission in effect when it was given unless the relevant parties separately confirm or transfer it.

Accounts, consultations and paid features

If accounts are introduced, you are responsible for keeping your credentials confidential and for activity carried out through your account. You must promptly notify us of suspected unauthorised use.

Consultations, submissions, purchases or other optional services may be subject to additional terms shown when the feature is offered, including prices, payment arrangements, cancellation rights and service-specific limitations. Those additional terms form part of this agreement for the relevant Service and take priority if they expressly conflict with these general terms.

Prohibited use

You may not use the Website:

• in a way that damages the Website, impairs its availability or interferes with another person's use of it;
• in a way that is unlawful, abusive, harassing, threatening, deceptive or otherwise objectionable, or in breach of an applicable law, regulation or order;
• to attempt unauthorised access to the Website, its systems or another user's account;
• to transmit malware, spam or unauthorised advertising;
• to copy or distribute protected Content without permission from its owner; or
• to systematically scrape, harvest or extract the Website's Content or lamp dataset except where applicable law expressly permits it.

What the lighting tool is and is not

The lighting tool is a planning guide, not a prescription. Its simulated values are estimates derived from lamp measurements and user-selected settings. Individual lamp output can vary with the sample, supply voltage, age, fixture, reflector, mesh, mounting, environment and measurement method. Results may therefore differ from the conditions represented in the Website or from measurements in a finished enclosure.

The Website does not replace suitable meters, manufacturer instructions, veterinary care, qualified electrical advice or an individual welfare assessment. You are responsible for checking actual output, choosing and installing equipment safely, monitoring the animal and deciding whether a setup is appropriate. Any consultation or care information is general information unless expressly agreed otherwise and is not veterinary advice.

External and affiliate links

The Website may contain links to sites operated by other people or organisations. We do not control those sites and are not responsible for their content, availability, products, terms or privacy practices. A link does not imply endorsement of the linked site or its operator.

Light My Reptile LLC participates in retail affiliate programs, including the Associates Program operated by Amazon Services LLC. Some product links carry an affiliate tag or referral parameter, and qualifying purchases made after following them may earn Light My Reptile LLC a commission from the retailer at no additional cost to you. Paid links are identified where they appear. Commissions do not determine which products are included or recommended.

Privacy and browser storage

If cookies, analytics or similar technologies are introduced, their use will be governed by the disclosures and consent choices published on the Website at that time.

Availability and warranties

The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Light My Reptile LLC disclaims express and implied warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, compatibility and availability. We do not promise that the Service will be uninterrupted, error-free, secure or free of harmful components, or that information and lamp data will always be current.

We may alter, suspend or discontinue any part of the Service. You are responsible for the security of your device and for retaining copies of any locally stored setups or exports that matter to you.

Some jurisdictions do not allow particular warranty exclusions. In that case, an exclusion applies only to the extent permitted by the law that applies to you.

Limitation of liability

Nothing in these terms excludes or limits liability for fraud, fraudulent misrepresentation, wilful misconduct, gross negligence, or death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited. Nothing in these terms affects consumer rights that cannot be waived.

To the fullest extent permitted by law, Light My Reptile LLC will not be liable for events beyond its reasonable control or for:

• indirect, incidental, special, exemplary, punitive or consequential loss or damage;
• business losses, including lost profits, income, revenue, anticipated savings, contracts, goodwill or commercial opportunities;
• loss or corruption of data, software, saved setups or exports; or
• loss, damage or injury resulting from reliance on a simulated result or from equipment selection, installation or use contrary to the responsibilities stated above.

Changes and general terms

• You may not transfer your rights under these terms. We may transfer our rights and obligations as part of a merger, reorganisation, financing, sale of the Website or sale of all or part of the business, provided the transfer does not reduce rights that cannot lawfully be reduced.
• We may revise these terms prospectively. The effective date will be updated, and we will give additional notice of a material change where reasonably appropriate. Changes do not retroactively alter the terms that governed earlier use.
• These terms and any feature-specific terms contain the agreement between you and us about the Service and replace earlier discussions about that subject.
• These terms do not create rights for anyone other than you and Light My Reptile LLC.
• If a court finds part of these terms invalid or unenforceable, that part will be enforced to the maximum lawful extent and the remaining terms will continue in effect.
• A delay in exercising a right or remedy is not a waiver of that or any other right or remedy.

Governing law and company details

These terms and any non-contractual dispute arising from them are governed by the laws of the State of Oregon, without regard to conflict-of-law rules. Any proceeding must be brought in a state or federal court located in Oregon, and you and Light My Reptile LLC consent to those courts' jurisdiction. This does not prevent a consumer from relying on a mandatory right or bringing a claim in another place where applicable law gives the consumer that right.
